1.1. This License Agreement (“License”) establishes the conditions for using the computer program “SunLauncher” (“Program”) and is entered into by any person using the Program (“User”) and the entity holding the exclusive rights to the Program (“Licensor”).
1.2. By copying the Program, installing it on your personal computer, or using the Program in any way, the User expresses full and unconditional agreement with all the terms of the License.
1.3. The use of the Program is permitted only under the terms of this License. If the User does not accept the terms of the License in their entirety, the User is not entitled to use the Program for any purpose. Use of the Program in violation (non-compliance) of any of the License’s terms is prohibited.
1.4. Use of the Program under the terms of this License for personal non-commercial purposes is free of charge. Use of the Program under conditions or in ways not provided for in this License is possible only based on a separate agreement with the Licensor.
1.5. This License and all relations related to the use of the Program are governed by the laws of the Russian Federation, and any claims or lawsuits arising from this License or the use of the Program must be filed and resolved in the court at the Licensor’s place of business.
1.6. The Licensor may provide the User with a translation of this License from Russian into other languages; however, in the event of any discrepancy between the Russian version and its translation, only the Russian version of the License shall be legally binding.
2.1. The exclusive rights to the Program belong to the Licensor.
3.1. The Licensor, free of charge and under a non-exclusive license, grants the User a non-transferable right to use the Program worldwide in the following ways:
3.1.1. To operate the Program for its direct functional purpose, which includes copying and installing (reproducing) it on the User’s personal computer(s). The User is entitled to install the Program on an unlimited number of personal computers. When installed on each personal computer, an individual number is assigned to each copy of the Program, which is automatically reported to the Licensor.
3.1.2. To reproduce and distribute the Program for non-commercial purposes (free of charge).
4.1. Except for use in the scope and manner expressly provided for by this License or by the legislation of the Russian Federation, the User is not entitled to modify, decompile, disassemble, decrypt, or perform any other actions with the object code of the Program aimed at obtaining information on the algorithms implemented in the Program, to create derivative works using the Program, or to otherwise use the Program or any of its components without the Licensor's written consent.
4.2. The User is not entitled to reproduce and distribute the Program for commercial purposes (including for a fee), including as part of a collection of software products, without the Licensor's written consent.
4.3. The Program must be used under the name: “SunLauncher”. The User is not entitled to change the Program's name, nor modify and/or remove the copyright notice or any other indication of the Licensor.
5.1. The Program is provided on an “as is” basis. The Licensor does not provide any warranties regarding the error-free and uninterrupted operation of the Program, its suitability for specific purposes or meeting the User's expectations, nor does it provide any other warranties not explicitly stated in this License.
5.2. To the maximum extent permitted by applicable law, the Licensor bears no liability for any direct or indirect consequences of using or being unable to use the Program and/or any damage caused to the User and/or third parties as a result of any use, non-use, or inability to use the Program or its individual components and/or functions, including any errors or failures in the Program’s operation.
5.3. The User is hereby informed and agrees that when using the Program, the following information is automatically and anonymously (without linking to the User) transmitted to the Licensor: the type of operating system on the User’s computer, the version and identifier of the Program, usage statistics of the Program’s functions, and other technical information.
6.1. The provisions of this License apply to all subsequent updates/new versions of the Program. By agreeing to install an update/new version of the Program, the User accepts the terms of this License for the respective updates/new versions of the Program, unless the update/installation of the new version is accompanied by a different license agreement.
